BENEVOLVENT GRANT TERMS & CONDITIONS

1. Grant Purpose:

The grant funds provided by Acorn Access LTD are intended solely for the purpose outlined in the grant application. Any significant changes to the project or its use of funds must be approved in writing by Acorn Access LTD.
2. Reporting and Documentation:

Grant recipients are required to provide regular progress reports when requested. These reports should detail the use of funds, project milestones achieved, and any challenges faced.
3. Financial Accountability:

Grant recipients must maintain accurate and transparent financial records related to the use of grant funds. These records may be subject to audit by Acorn Access LTD or its representatives.
4. Public Recognition:

Grant recipients may be asked to acknowledge Acorn Access LTD as a funding source in their project's promotional materials, website, and other relevant communication.
5. Funds Disbursement:

Grant funds will be disbursed as specified in the grant application Any changes to the disbursement schedule must be requested in writing and approved by Acorn Access LTD.
6. Project Completion:

Grant recipients are expected to complete the project within the timeframe specified in the grant application. If an extension is required, it must be requested in writing and approved by Acorn Access LTD in advance.
7. Unused Funds:

Any unspent grant funds must be returned to Acorn Access LTD at the conclusion of the project, as specified in the grant application.
8. Acknowledgment of Impact:

Grant recipients may be asked to provide testimonials, stories, or other forms of acknowledgment to demonstrate the impact of the grant on their organization or project.
9. Legal Compliance:

Grant recipients are responsible for complying with all relevant local, state, and federal laws and regulations related to their project and organization. Failure to do so may result in the termination of the grant.
10. Grant Repayment: - If grant funds are not used for their intended purpose, misused, or if the recipient violates any of these terms and conditions, Acorn Access LTD reserves the right to require repayment of the grant amount.
11. Grant Evaluation: - Acorn Access LTD may conduct evaluations or site visits to assess the progress and impact of the funded project.
12. Grant Recognition: - Grant recipients agree to allow Acorn Access LTD to use their organization's name, logo, and project information for promotional and reporting purposes.
13. Termination of Grant: - Acorn Access LTD reserves the right to terminate the grant if the recipient fails to adhere to these terms and conditions, or if the project's objectives are not being met as agreed upon.
14. Confidentiality: - Any confidential information shared between the grant recipient and Acorn Access LTD should be treated with the utmost confidentiality and not disclosed to third parties without consent.
By accepting the grant, the recipient acknowledges and agrees to abide by these terms and conditions. Failure to comply with these terms may result in the revocation of the grant and the requirement to return the funds received.
Limited Liability Clause:

Limitation of Liability:
a. Grantor's Liability: The Grantor, Acorn Access LTD, shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the grant, including but not limited to loss of profits, loss of data, loss of reputation, or any other damages, even if the Grantor has been advised of the possibility of such damages.
b. Recipient's Liability: The Recipien shall indemnify and hold harmless the Grantor against any claims, liabilities, costs, expenses, damages, or losses, including reasonable legal fees, arising from or in connection with the recipient's use of the grant funds or the implementation of the project.

No Warranty:
The Grantor makes no representations or warranties, whether expressed or implied, regarding the suitability, accuracy, or completeness of the grant for the recipient's intended purpose. The grant is provided "as is" and without warranty of any kind, either expressed or implied.

Limitation of Remedies:
The sole and exclusive remedy available to the recipient in the event of any dispute or dissatisfaction with the grant shall be the termination of this Agreement. In no event shall the recipient have any right to seek injunctive or other equitable relief.

Not a Guarantee:
Acceptance of this grant does not constitute a guarantee or promise of any future funding or support from the Grantor. Future funding decisions will be made independently based on the recipient's performance and the availability of resources.
